NEGLIGENT SECURITY/WRONGFUL DEATH SHOOTING
In today’s Miami Herald, June 5, 2024, a story appeared concerning the unfortunate shooting death of beloved high school football coach Keon Smith. Coach Smith was shot at an apartment building at 2852 NW 132nd Street, in Miami, Florida. This area, known as Opa-Locka, has a high crime rate according to police statistics. Our firm recently represented the victim of another shooting at this same complex, Aswan Village – fortunately, our client lived despite being shot 9 times.
As the public record reveals, Aswan Village and the surrounding areas have a higher than normal incidence of violent crime. When an apartment complex or other residential facility has reason to know that their residents, guests, visitors, and business invitees are at risk for criminal violence, they have a duty, under Florida law, to provide reasonably safe measures to address this danger. Such features as security cameras, access control, gates, security guards, off duty police, lighting, and other measures are taken by residential apartment complexes and other businesses to protect their patrons, visitors and guests.
