Fee Arrangements
We offer referral fee and joint venture arrangements that conform to Florida Bar regulations while properly reflecting the division of labor and risk involved in a given case collaboration.
See Florida Bar Rule 4-1.5(f)(4)(D) for specific guidelines on the reasonable division of fees between lawyers in different firms, whether based on collaboration with primary and secondary responsibility, or substantially equal active participation. The basic standard for division of fees is as follows:
- Minimum of 75% of the total fee to the lawyer assuming primary responsibility.
- Maximum of 25% of the total fee to the lawyer assuming secondary responsibility.
- If equal active participation, the 25% limitation shall not apply. Counsel must apply to the court for authorization of the fee division contract.
